The Cherokee County Probate Court is in Canton on North Street. This is where all marriage licenses, wills, estate records, and guardianship files are kept for the entire county. Records start in 1832, the year Cherokee County was organized. Under O.C.G.A. § 15-9-30, the Probate Court handles wills, estates, guardianships, and marriage licenses.

Cherokee County records begin in 1832 because the county was formed from Cherokee Nation land that year. Before 1832, this area was not part of any Georgia county. Some related records may exist in Georgia's lottery records from the same period.

Land and Deed Records in Canton

The Cherokee County Superior Court Clerk in Canton keeps all land records. Deed books, plat maps, and property transfers go back to 1832. These records are public under O.C.G.A. § 50-18-70.

Georgia started statewide birth and death registration in 1919 under O.C.G.A. § 31-10-9. For records after that date, contact the Georgia Department of Public Health. Birth certificates cost $25. Death certificates are the same price.

Birth certificate access has limits. Under O.C.G.A. § 31-10-26, certified copies go only to the named person, parents, grandparents, adult children, siblings, spouses, or guardians. Death certificates are more open and very useful for genealogy. They list parents' names, birth dates, and burial information.
